Appointment of Arbitrators
The parties freely appoint their arbitrators in accordance with the arbitration agreement and the Rules (Legislative Decree 1071, Articles 22 and 23). Where no such appointment is made, the appointment falls to the Center.
Cases in which the Center makes the appointment
- Where a party fails to appoint its arbitrator within the time limit set out in the Rules.
- Where the arbitrators appointed by the parties cannot agree on the appointment of the presiding arbitrator.
- Where the parties have expressly entrusted the appointment to the Center in the arbitration agreement.
In all these cases, the appointment is made from the current Roster of Arbitrators, taking into account the subject matter of the dispute, the amount in dispute and the availability declared by the arbitrator.
The Center does not decide the merits. Its role is limited to organizing and administering the proceedings; the decision on the dispute rests solely with the arbitral tribunal (Legislative Decree 1071, Article 7).
Pending from client: internal appointment procedure, time limits in business days, Roster rotation criteria and applicable challenge regime.
