Does the Dispute Board halt the works?
No. The Board may order provisional and conservatory measures, but not measures that suspend performance of the contract.
Must I comply with the decision if I disagree with it?
Yes. It is binding and must be complied with immediately upon notification, even if the party reserves the right to resort to arbitration.
Can I go directly to arbitration?
Not where the Board is mandatory: exhausting the procedure before it is a precondition to arbitration, unless the Board fails to issue a decision within the time limit or is dissolved.
When is the Board constituted?
Before the performance period of the works begins. Its constitution and the signing of the tripartite agreement are prerequisites.
