FAQ

Questions that commonly arise before signing an arbitration agreement or commencing proceedings.

How long does an arbitration take?

It depends on the complexity of the case and the number of claims. The Rules set the time limit for rendering the award at [X] business days from [milestone], which may be extended in the circumstances they provide for.

Can the award be appealed?

No. The award is final and not subject to appeal. The only remedy is an action to set aside before the Superior Court, on the limited grounds set out in Article 63 of Legislative Decree 1071, which does not permit review of the merits.

Can any dispute be arbitrated?

Disputes over matters that the parties may freely dispose of under the law, as well as those authorized by law or by treaty, may be submitted to arbitration (Article 2).

What if my contract has no arbitration clause?

The parties may enter into a subsequent arbitration agreement. The template is available on the Model Arbitration Clause page.

Can the Center decide my case?

No. The Center administers the proceedings; the decision rests with the arbitral tribunal.

How much does it cost?

The filing fee, administrative fees and arbitrators' fees are set out in the Schedule of Fees and depend on the amount in dispute.

Pending from client: time limit for rendering the award in business days and the milestone from which it runs.
