The arbitration commences on the day we receive your request

Arbitral proceedings commence on the date the Center receives the request, unless the parties have agreed otherwise (Legislative Decree 1071, Article 33). The time limits under the Rules run from that day.

Institutional arbitration

A final, unappealable award with res judicata effect

ANDEARB organizes and administers arbitrations in which the parties have agreed to submit their disputes to this institution. The decision on the merits rests solely with the arbitral tribunal.

FAQ

Questions that commonly arise before signing an arbitration agreement.

Can the award be appealed?

No. The award is final and not subject to appeal. The only remedy is an action to set aside before the Superior Court, on the limited grounds set out in Article 63 of Legislative Decree 1071, which does not permit review of the merits.

Can the Center decide my case?

No. The Center administers the proceedings; the decision rests with the arbitral tribunal.

What if my contract has no arbitration clause?

The parties may enter into a subsequent arbitration agreement. The template is available on the Model Arbitration Clause page.
